Short answer: A refund depends on the contract and applicable law; “it failed inspection” is not a complete payment rule. Before sending a deposit, define the evidence that allows cancellation, who decides, permitted deductions and the refund deadline. Match the buyer agreement to the dealer’s reservation terms.

Name the payments correctly

A sourcing/inspection fee, a dealer reservation payment and part-payment of the vehicle price serve different purposes. Do not combine them into one unexplained “deposit.”

Ask who holds each amount, when it becomes committed, whether it can be transferred to another VIN, and what happens if the seller—not the buyer—cannot proceed.

If KingStone collects money for a dealer reservation, the two contracts should not create conflicting refund promises.

Agree observable rejection triggers

The following is a negotiation checklist, not KingStone’s automatic refund policy:

Structural repair inconsistent with the description: Evidence standard and rejection right

Undisclosed flood concern: Specialist verification and decision deadline

Material mileage discrepancy: Review process and remedy

Ownership/export obstacle: Cure deadline or cancellation

Minor disclosed cosmetic damage: Accepted condition, repair or renegotiation

A buyer’s change of mind should be addressed separately from a material misdescription. Do not let “any issue” be the only definition: used vehicles often have minor wear.

Decide who provides the evidence

Identify the inspector’s qualifications and scope, the report format and access needed. Agree who pays for a second assessment if findings are disputed and whether the vehicle stays reserved during that review.

Photographs, diagnostic files and a signed conclusion should support the dispute; one unexplained paint-meter reading should not decide a high-value purchase alone.

Put refund mechanics in the contract

Specify the refund currency, return account, deadline, bank fees and any approved deductions. Distinguish money still held from third-party costs already incurred with the buyer’s authorization.

Do not rely on a blanket “100% refundable” chat message. For an expensive transaction, have the governing law, dispute forum and remedies reviewed by qualified counsel.

The simplest commercial protection is to complete inspection before irreversible buyout where the seller allows it. If a deposit is needed first, its conditions must be clear before—not after—the result.
